§ Privacy Policy

[1.0] BrandCreativePoint, located at An der Steinkaut 14, 65232 Taunusstein, Germany ("we," "us," or "our"), is committed to protecting the privacy of our clients, website visitors, and service users. This Privacy Policy outlines how we collect, use, and safeguard personal data in compliance with the EU General Data Protection Regulation (GDPR).

[1.2] Data We Collect. When you submit a contact form or engage our services, we may collect: full name, email address, phone number, project details, company information, and any voluntary correspondence. We do not collect payment card data directly — payments are processed via Stripe's PCI-compliant infrastructure.

[1.3] Purpose of Processing. Personal data is processed solely to: respond to inquiries, deliver contracted services, send project-related communication, fulfill legal obligations, and improve our service offerings.

[1.4] Legal Basis. We process data under GDPR Article 6(1)(b) — performance of a contract — and Article 6(1)(f) — legitimate interest in responding to inquiries and improving services. Where consent is required, we obtain explicit opt-in before processing.

[1.5] Data Retention. Personal data is retained for the duration necessary to fulfill the purpose for which it was collected, or up to 24 months after the last client interaction, whichever is longer. Data is securely deleted thereafter.

[1.6] Data Sharing. We do not sell or rent personal data to third parties. Data may be shared with: Stripe (payment processing), Google Maps (location services), and hosting providers essential to service delivery — all bound by Data Processing Agreements.

[1.7] Your Rights. Under GDPR, you have the right to: access, rectify, erase ("right to be forgotten"), restrict processing, data portability, and object to processing. To exercise these rights, email [email protected]. You may also lodge a complaint with the German Federal Commissioner for Data Protection (BfDI).

[1.8] International Transfers. Data may be transferred outside the EU/EEA to service providers operating under Standard Contractual Clauses (SCCs) or equivalent safeguards as required by GDPR Chapter V.

§ Terms of Service

[2.0] These Terms of Service ("Terms") govern all engagements between BrandCreativePoint, An der Steinkaut 14, 65232 Taunusstein, Germany, and any client or user accessing our services. By engaging BrandCreativePoint, you agree to be bound by these Terms.

[2.1] Scope of Services. BrandCreativePoint provides brand identity design, creative strategy, visual design systems, packaging design, motion branding, and related creative services as described in individual project proposals and service descriptions.

[2.2] Project Proposals. All work begins with a written project proposal defining scope, deliverables, timeline, and pricing. Proposals are valid for 30 days from the date of issue. Work outside the agreed scope requires a written change order.

[2.3] Pricing & Payment. Prices are quoted in Euros (EUR) unless otherwise specified. Payment is due per the milestones outlined in the project proposal. Invoices are payable within 14 days of issue. Late payments incur a statutory interest rate of 9 percentage points above the ECB base rate.

[2.4] Intellectual Property. Upon full payment, BrandCreativePoint grants the client a perpetual, non-exclusive license to use all final deliverables. BrandCreativePoint retains the right to display work in portfolios and case studies unless otherwise agreed in writing.

[2.5] Revision Policy. Each project includes up to two (2) rounds of reasonable revisions. Additional revisions are billed at €120/hour. Revisions must not alter the original approved scope.

[2.6] Project Timeline. Timelines begin upon receipt of the initial payment and all required client materials. Delays in client feedback or material delivery extend the timeline proportionally. BrandCreativePoint is not liable for delays caused by third-party dependencies.

[2.7] Confidentiality. Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination for a period of two (2) years.

[2.8] Termination. Either party may terminate with 14 days' written notice. Upon termination, the client is invoiced for all work completed up to the termination date. Non-refundable third-party costs incurred on behalf of the client are also chargeable.

[2.9] Limitation of Liability. BrandCreativePoint's total liability shall not exceed the total fees paid under the applicable project agreement. We are not liable for indirect, consequential, or incidental damages.

§ Cookie Policy

[3.0] BrandCreativePoint uses cookies and similar technologies to ensure basic website functionality, remember your cookie consent preferences, and analyze aggregate, non-identifying traffic data. This policy explains what cookies we use and why.

[3.1] Essential Cookies. Required for core site functionality. These include session management, CSRF protection, and the cookie consent flag stored in your browser's localStorage. These cookies cannot be disabled.

[3.2] Analytics Cookies. If enabled, we may use privacy-respecting analytics tools to collect aggregate, anonymized data about site usage (e.g., page views, session duration, referral sources). No personally identifiable information is stored in analytics cookies.

[3.3] Third-Party Cookies. Embedded Google Maps iframes may set cookies in accordance with Google's privacy policy. We do not control third-party cookie behavior and recommend reviewing Google's Cookie Policy for details.

[3.4] Managing Cookies. You can control or delete cookies through your browser settings. Disabling essential cookies may impair website functionality. The cookie consent banner allows you to accept or decline non-essential cookies at any time.

[3.5] Cookie Consent. In compliance with the EU ePrivacy Directive, we display a cookie consent banner upon your first visit. Your consent preference is stored in localStorage and respected across sessions. You may withdraw consent at any time by clearing your browser's localStorage.

§ Refund Policy

[4.0] BrandCreativePoint is committed to fair and transparent refund practices. This policy outlines the conditions under which refunds or partial reimbursements may be issued for services rendered.

[4.1] Project Milestone Refunds. If a project is cancelled by the client before completion, a refund is issued for any prepaid work that has not yet been delivered. Work already completed is non-refundable. Refunds are calculated proportionally based on project milestones.

[4.2] Work Not Meeting Specifications. If delivered work materially deviates from the approved project proposal and written specifications, the client must notify BrandCreativePoint within 14 days of delivery. We will remedy the deviation at no additional cost. If remediation is not possible, a partial refund will be issued.

[4.3] Non-Refundable Items. The following are non-refundable: third-party costs incurred on behalf of the client (e.g., stock imagery licenses, printing fees, domain registrations), completed and approved deliverables, and consultation sessions that have been delivered.

[4.4] Refund Process. Refund requests must be submitted in writing to [email protected] with the project name, invoice number, and reason for the refund. Refunds are processed within 14 business days of approval via the original payment method.

[4.5] Statutory Rights. Nothing in this policy affects your statutory rights under German consumer protection law (BGB §§ 355–356) or the EU Consumer Rights Directive. You have a 14-day withdrawal right for distance contracts, unless services have commenced with your express consent.

[4.6] Dispute Resolution. In the event of a dispute regarding refunds, both parties agree to attempt good-faith resolution via email communication before pursuing formal legal proceedings. BrandCreativePoint is willing to participate in alternative dispute resolution through the EU Online Dispute Resolution platform.
